YOUNG AND SEEN (PTY) LTD, trading as Young & Seen, is committed to processing personal information lawfully, reasonably, transparently and securely in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Information we may collect

Depending on the service used, Young & Seen may collect:

• parent or guardian name,
• contact details,
• relationship to the child,
• young person’s first and full name where needed internally,
• date of birth and age,
• province and broad location,
• photographs,
• videos or links,
• writing, poetry, art and other creative work,
• biographies and answers supplied for editorial profiles,
• photographer or creator credits,
• consent and rights declarations,
• order, payment-reference and delivery information,
• website/device information,
• marketing preferences,
• correspondence and support records.

Young & Seen does not need racial classification for ordinary submissions and should not collect it merely to measure diversity.

3. Children’s information

POPIA provides special protection to children’s personal information.

For a person under 18, Young & Seen relies primarily on prior consent from a legally competent parent or guardian before processing personal information for submission and publication purposes.

Young & Seen will not knowingly publish a minor’s home address, precise geolocation, unnecessary school information, identity number or other unnecessary identifying information.

4. Why we process information

We may process information to:

• receive and evaluate submissions,
• verify consent and rights,
• contact parents, guardians, creators and photographers,
• edit and publish selected features,
• distribute magazines and digital editions,
• operate the website and shop,
• process orders and support customers,
• prevent fraud and misuse,
• maintain legal and publication records,
• manage advertisers and suppliers,
• send marketing where lawful consent or another lawful basis exists,
• comply with legal obligations.

5. Marketing consent

Marketing consent is separate from publication consent.

A person may choose whether to receive newsletters, edition announcements, offers and promotions.

The marketing checkbox must be optional and unticked by default.

A person may unsubscribe at any time through the unsubscribe mechanism or by contacting privacy@youngandseen.co.za.

6. What we publish

Where publication consent is given, Young & Seen may publish approved combinations of:

• first or preferred name,
• age,
• province,
• approved biography or profile information,
• submitted creative work,
• approved photograph,
• photographer / creator credit.

Publication may occur in physical magazines, PDF or EPUB editions, the Young & Seen website and approved Young & Seen social-media channels, subject to the consent granted.

7. Service providers

Young & Seen may use operators or service providers for:

• hosting,
• WordPress functionality,
• email,
• cloud storage,
• payment processing,
• delivery,
• security,
• analytics,
• marketing,
• printing,
• publishing and fulfilment.

Only information reasonably necessary for the relevant service should be shared.

Where an operator processes personal information on Young & Seen’s behalf, appropriate confidentiality and security obligations should apply.

8. Cross-border processing

Young & Seen will assess whether a service provider stores or processes information outside South Africa.

Personal information will be transferred outside South Africa only where lawful safeguards under POPIA apply.

Children’s information should not be transferred to a foreign recipient lacking adequate protection without first resolving any applicable consent and prior-authorisation requirements.

9. Security

Young & Seen will use reasonable technical and organisational safeguards, including:

• access controls,
• strong administrator authentication,
• secure hosting,
• backups,
• encryption in transit,
• restricted submission access,
• security updates,
• appropriate operator agreements,
• incident response procedures.

No system is completely immune from risk.

10. Retention

Young & Seen will not retain personal information longer than reasonably necessary.

Default approach:

• unselected submissions: up to 6 months,
• selected submissions and publication consents: for as long as reasonably necessary for publication, archive, rights management and legal defence,
• marketing details: until consent is withdrawn or an opt-out is received, subject to a minimal suppression record,
• order and accounting records: for applicable statutory periods.

Information may be retained longer where law, litigation, fraud prevention or another lawful requirement justifies it.

11. Rights

Subject to POPIA and PAIA, a person may request:

• confirmation whether Young & Seen holds their information,
• access to information,
• correction or updating,
• deletion where legally appropriate,
• restriction where applicable,
• withdrawal of consent,
• objection to certain processing,
• stopping direct marketing.

Young & Seen may request reasonable proof of identity before acting.

12. Withdrawal of publication consent

Withdrawal of consent affects future processing where consent is the lawful basis.

Withdrawal does not automatically undo lawful processing already completed.

A physical magazine already printed or distributed, an edition already sold or a historic editorial archive may not be capable of complete recall. Young & Seen will, however, assess reasonable requests relating to future digital use, promotion and continued processing.

13. Security incidents

If Young & Seen has reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, it will follow its breach procedure and make notifications required by POPIA.

14. Complaints

Privacy complaints should first be sent to privacy@youngandseen.co.za.

A person also has the right to approach the Information Regulator of South Africa.

15. Updates

This Privacy Policy may be updated as systems, vendors and legal requirements change.

Our event implementation does not include names, email addresses, submission answers, child details or submission references.
